Approval of Minutes

MOTION by Selectman Grady and SECONDED by Selectman Tirrell to approve Executive Session minutes with the addition of: (about one third of the way up from the bottom we have a vote to sign the Purchase and Sales Agreement, I believe that I amended the motion to say) that it was subject to receipt of a satisfactory Title Examination and approval of the Town Meeting on November 5, 2001.

MOTION by Selectman Tirrell and SECONDED by Selectman Grady to approve minutes of October 9, 2001 with the following changes: On page two under the subject Tahanto Docks delete the words "Attorney Troy" and insert "Town Councel". On page one the bottom of page three delete the word "Haydon" and change to "Selectman Coggeshall"

Jay Stahl - Interviewing Techniques

Mr. Stahl gave a background on himself, and spoke on interviewing techniques. Handouts were given to the Board of Selectmen and Town Administrator to go along with his presentation.

Discussion was held on these techniques.

Massachusetts Maritime Presentation on the Bourne Marina

Michael Joyce, Vice President of Administration and Finance at the Massachusetts Maritime Academy gave a brief history on the Massachusetts Maritime Academy operating the Bourne Marina for the past four years for the Town of Bourne.

Thomas McKenzie, Marina Manager of Bourne Marina gave a slide presentation of the marina.

Proposed rates for next year:

Launching Ramp $10 per day

Docks A-E (cable and telephone) $115 per foot

Docks G-J $95 per foot (no electricity or cable)

Transient Dockage: $2.50 per foot

Would like the Board of Selectmen to approve the new rates. The Board of Selectmen requested that a letter be submitted with their request to be heard at next week’s meeting.

James Mulvey of Buzzards Bay commented on management fees, pilings and ramp.

MOTION by Selectman Grady and SECONDED by Selectman Tirrell move to have a short recess for just a couple of minutes until things get settled.

Barnstable County Commissioners Assisted Living

Mark Zelinski, County Administrator for Barnstable County distributed handouts.

Assisting with the presentation were Rand Drew of Realty Resources Charter of Maine, Pat Fiaro of the Hyannis Housing Assistance Corporation, Roland Dupont, County Commissioner, Paul Ruchinskas, the new housing officer for the Cape Cod Commission and Martha Twombly of the Cape Cod Commission.

Rand Drew presented handouts to the Selectmen and went through the project overview.

There will be 84 units with 60 assisted living units and 24 independent living units. These would be targeted for the median income and to be 65+ years olds.

Rents, services, site plan, design and financial overviews were discussed.

James Mulvey of Buzzards Bay commented on the residents of Bourne having a preference.

Commission on Disabilities

MOTION by Selectman Locke and SECONDED by Selectman Grady to appoint Stephen Lukacinsky to the Commission on Disabilities for a two-year term.

MOTION by Selectman Locke and SECONDED by Selectman Grady to appoint Valerie Jean Hayes for a two year term to the Commission on Disabilities

Shore and Harbor Committee

MOTION by Selectman Tirrell and SECONDED by Selectman Locke nominated John O'Neil Jr. of Sagamore Beach to the Shore and Harbor Committee for a period of three years.

MOTION by Selectman Grady and SECONDED by Selectman Covell that Gregory Fayne be nominated to the Shore and Harbor Committee for a three-year term.

MOTION by Selectman Locke and SECONDED by Selectman Grady to nominate Mr. Richard Conron for a one-year term as an alternate to the Board of Appeals.

It was requested that these appointments be made in two weeks.

Barnstable County Coastal Resources Committee (alternate)

MOTION by Selectman Covell and SECONDED by Selectman Grady to appoint John J. O’Neil, Jr. of Sagamore Beach to the Barnstable County Coastal Resources Committee as an alternate for a period of one year.

Barnstable County Dredge Committee (alternate)

MOTION by Selectman Grady and SECONDED by Selectman Covell to appoint John J. O'Neil Jr. to the Barnstable County Dredge Committee as an alternate for a period of one year.

Conservation Commission

MOTION by Selectman Grady and SECONDED by Selectman Locke to appoint Mr. Vincent Greco, of Pocasset to fill the vacancy on the Conservation Commission for a one-year term.

Private Petition Tax Incentive Financing for Special Town Meeting

Attorney Richard Driscoll and architect Greg Siroonian made a presentation on the behalf of the applicant Noreen Michienzi known as the "One Trowbridge Road Economic Development Area Project."

Mr. Dennis Hanks from the Commonwealth of Massachusetts, State Office of Business Development made a presentation on how the program works with the State.

John Harding of Realty Executives who prepared the application for the Tax Incentive Program gave an explanation of the application.

James Mulvey of Buzzards Bay commented on the project.

The Board of Selectmen took no action

Possible Cape Cod Commission Referral

Coreen Moore, Town Planner made her presentation on the One Trowbridge Road Economic Development Area project. Revised plans were presented to the Town Planner today and she has based her findings on these new plans. In her opinion, there were some issues and requested that this project be submitted to the Cape Cod Commission for a clarification.

Sharon Rooney, Senior Regulatory Planner of the Cape Cod Commission Staff gave her interpretation of the application. In her opinion this project should be reviewed by the Cape Cod Commission. She gave the options that there are available:

Mandatory Referral – is not an option tonight- the commission could pick it up on its own – you could endorse that action by the commission

Jurisdictional Determination – legal determination if this project applies – does not stop the clock on the permits with other boards.

Discretionary Referral – done after the jurisdictional determination – town boards could refer to the commission

Attorney Richard Driscoll requested that this project not be referred to the Cape Cod Commission.

THE MOTION CARRIES

Private Petition on Public Safety Residency

Penny Eldridge and Mark Taylor of the Bourne Fire Department, and Kim Young of the Bourne Police Department presented their petition requesting to change the town by law on residency for public safety officials from living within the Town of Bourne to the Civil Service limits of a 10 mile radius.

The Board of Selectmen suggested that they negotiate in the union contracts instead of going to town meeting.

Discussion was held.

Selectman Tirrell commented on articles 7 and 8 for the special town meeting.

Selectman Locke spoke on the application of George Gonsalves for a Class II Dealers License. No action was taken, as there are too many questions appeared on the routing slip.

Town Administrator’s Report

Two Civil Service appointments have been made. Sargent Gould and Sargent Baldwin of the Police Department have been promoted to Lieutenants.

There is a panel set up to interview for the new fire chief.

Budget forms have been sent out for 2003.

Public Comments:

James Mulvey of Buzzards Bay commented on the position of the Department of Natural Resources Director

Robert Deane of Bourne commented on the cable being installed on Sandwich Road.
