Chairman Coggeshall opened meeting. Selectman Locke made a motion and it was seconded by Selectman Grady to go into executive session with Town Counsel to discuss Pending Legal Matters and that we will reconvene in open session at approximately 7:00 p.m.

Approval of Minutes

MOTION by Selectman Grady and SECONDED by Selectman Tirrell to approve minutes of Executive Session October 30, 2001 with the following changes: change the word "Station" to "Status".

MOTION by Selectman Grady and SECONDED by Selectman Covell to approve minutes of October 30, 2001 with the following changes: on page 4 Change the name of "Amy Dwyer" to "Aimee Neading" and on page 3 delete the word "true" from the motion

Communications

The hearing by the Cape Cod Commission will be held on "One Trowbridge Road" project. We received a request to withdraw our request for a Jurisdictional Review as applicant will be filing a change of use application tomorrow.

Martha Twombley of the Cape Cod Commission commented on the application. She was not in favor of withdrawing the petition and felt that the hearing on Thursday night should go forward.

Discussion was held

MOTION by Selectman Locke and SECONDED by Selectman Grady that we do not withdraw our petition and we go forward with the Cape Cod Commission hearing scheduled for Thursday night.

Board of Assessors Classification Hearing

Donna Barakauskas, Principal Assessor presented the tax rates.

MOTION by Selectman Tirrell and SECONDED by Selectman Coggeshall move that we continue as before and classify all property in the same manner.

UNANIMOUS VOTE by the Board of Assessors (Selectmen Coggeshall, Locke and Tirrell only)

Shellfish Violation - George Aguiar

Acting Director of the Department of Natural Resources, Michael Gratis, presented the information on the violation of shell fishing in Red Brook Harbor, a closed area.

Mr. Aguiar - I was wrong. I am guilty.

Discussion was held

 

Selectman Coggeshall and Covell thought that a longer suspension was warranted.

MOTION by Selectman Locke and SECONDED by Selectman Grady that we suspend the gentlemen’s license for a period of 30 days, with time served, and that he be forewarned that the next violation will be have serious consequences.

MOTION CARRIES

Town Administrator requested that the Board of Selectmen vote on the tax rate.

MOTION by Selectman Tirrell and SECONDED by Locke move that the town continue in the same tax scheme and not use the benefits of the classification statue.

Christy's - Presentation by Attorney Ford O'Connor

Attorney Ford has requested this to be rescheduled to Nov 27th

Cataumet School House Preservation Group - Presentation by Ben Joyce

Ben Joyce explained how the restoration has been done and what they a working on at this time. All have been done with volunteer efforts and monies from fund raising. A bell has been purchased. The site has been deemed a historical site. The Cataumet School House Preservation Group would like permission from the Board of Selectmen to install a belfry and a pellet stove.

Discussion was held.

Comments were received from Nancy Eldridge of Cataumet, Jim Mulvey of Buzzards Bay and Robert Hampton of Cataumet.

MOTION by Selectman Grady and SECONDED by Selectman Tirrell move that we grant permission and authority to the Cataumet Schoolhouse Preservation Group to construct, erect, install the belfry according to the plans that were submitted.

Community Building Committee Appointments

There are two positions to be appointed by the Board of Selectmen.

MOTION by Selectman Tirrell and SECONDED by Selectman Grady I would appoint Selectman Wayne Covell and John R. Spanks for our two appointments.

Certificate of Vote on the Land Acquisition for the Grossman Property

The Certificate of vote was read by Chairman Coggeshall regarding that purchase of Open Space property on Main Street, Buzzards Bay.

MOTION by Selectman Grady and SECONDED by Selectman Covell move that the Board of Selectmen sign the certificate that you just read.

Town Public Works Services; Introduction on Walter Tonaszuck

Town Administrator spoke on the new position of Communities Services Manager. Rickie Tellier had requested that he be moved back to the assistant superintendent position. This position has become vacant with the retirement of Bob Weeks. An organizational chart was provided as to how this will work. This would accomplish filling the slot and of the Superintendent of DPW and to assist other departments.

Walter Tonaszuck will be filling this position. He comes with 29 years of experience in town government.

Wally Tonaszuck spoke on his accomplishments.

Comments were received from Lucia Fulco of Cataumet on the organizational chart and Charles Miller of Monument Beach on docks and piers.

Other Matters

Pilgrim Pines Development

A routing slip is being circulated to all departments to get their comments on this development. Reports have been received from the Town Planner, Building Inspector and Board of Health. We are still waiting for other departments to respond.

MOTION by Selectman Grady and SECONDED by Selectman Covell that we ask the developer to voluntarily to submit sub division plans, a traffic plan, and drainage calculations conducted by a professional engineer.

Letter was received from Governor Swift’s office requesting the Board of Selectmen make an appointment to the Community Advisory Counsel.

MOTION by Selectman Grady and SECONDED by Selectman move that Mr. Haydon Coggeshall who has been the member of the Senior Management Review Board for 9 years with a great record and good communications between the Board and the Town that he continue in that capacity be on this committee as the Town of Bourne’s representative.

Town Administrator’s Interviews

Selectman Covell gave each member of the Board his questions for the interviews.

Lucia Fulco of Cataumet commented on the Town Administrator’s interviews.

Jim Mulvey of Buzzards Bay commented on Pilgrim Pines traffic issues.

Charles Miller of Monument Beach commented on Mr. Tonaszuck's position.

MOTION by Selectman Grady and SECONDED by Selectman Covell to adjourn.
