Chairman Grady announced that Selectman Locke would not be attending tonight due to a serious illness in his family.
Approval of Minutes
MOTION by Selectman Covell and SECONDED by Selectman Zuern approve of minutes of December 17, 2002.

Correspondence
Selectman Tirrell went over all correspondence that had been received. The Board would like the new Assembly of Delegates Representative Joseph Carrara to come before them to go over the State Funding and County Surplus funds.
Chairman Grady also requested that the two new State Representatives (Susan Williams Gifford and Jeffrey Perry) come before the Board of Selectmen to introduce themselves.
A letter was received from the Board of Health stating that Elio's North End Deli has received their serve safe certificate and requested that the Board approve their Common Victualler's License.
MOTION by Selectman Tirrell and SECONDED by Selectman Zuern approve the Common Victualler's license for Elio's North End Deli.

7:15 p.m. Cumberland Farms - Special Permit
Devra Bailin of Cumberland Farms requested that the hearing be postponed due to the absence of Selectman Locke.
Chairman Grady went over the draft decision that was prepared and requested that the Board review the draft and discuss further amendments and make a decision next week.
Devra Bailin presented the Board with the information that was discussed at the last meeting.
Selectman Zuern expressed her concern on the absence of Selectman Locke and thought that the Board should wait to go over the changes. She also spoke on reducing the number of pumps from 8 to 4, changing the location of the pumps, landscaping and lighting.
Discussion was held.
Selectman Covell stated his concerns on the increase of traffic with the pumps, nonconforming use and the attendants.
Devra Bailin stated that by reducing the number of pumps it would not be economically feasible and there would be more traffic congestion. She also commented on the sign enforcement.

It was agreed by the Board of Selectmen and Devra Bailin of Cumberland Farms that the hearing for both the Special Permit and the Underground Storage Tanks be continued until next week and would then be further continued if Selectman Locke is not able to attend.
Special and Annual Town Meeting Warrant
Town Administrator William Griffin went over the time frame for the Special Town Meeting required by the Charter and requested that the Warrant be opened tonight and closed on January 17, 2003. He also asked that the Board vote to hold a Special Town Meeting on March 3, 2003.
MOTION by Selectman Covell and SECONDED by Selectman Zuern we hold a Special Town Meeting on March 3, 2003. Open the warrant on January 7, 2003 and close the warrant on January 17, 2003.
UNANIMOUS VOTE (4-0)
Town Administrator requested that the Board open and close the warrant for the Annual Town Meeting.
MOTION by Selectman Covell and SECONDED by Selectman Zuern we hold the Annual Town Meeting on May 12, 2003. Close the warrant on February 21, 2003.

Trading Post Lounge - Request for closure
Letter was read by Chairman Grady received from owner/manager Kristine Fox of the Trading Post Lounge requesting to close her establishment on January 26, 2003 from 5:00 to 10:00 p.m. for the purpose of a private function for employees and regular customers.
MOTION by Selectman Tirrell and SECONDED by Selectman Zuern we approve the request of the Trading Post Lounge to close to the General Public, Sunday January 26, 2003 from 5:00 to 10:00 p.m. pending a letter of no objection from the Police Chief.

Amendment to Shellfish Regulations
George Weinert, Director of the Department of Natural Resources, went over Shellfish Amendment 2003-1, the opening of a contaminated relay. The Shellfish have been tested and shown by the State to be wholesome. There is one change for the Commercial Shellfishmen and that is they may collect on Wednesdays and Fridays until 3:30 p.m.

MOTION by Selectman Covell and SECONDED by Selectman Tirrell accept Shellfish Regulation Amendment No: 2003-1.
UNANIMOUS VOTE (4-0)
Commercial Fisherman Tom Barlow requested to go on record that he was in favor of this amendment.
ISWM Working Group - Selectmen Designees
Chairman Grady stated that Selectman Tirrell is to serve as Chairperson and Selectman Covell as a member of the ISWM Working Group.
Selectmen's Reports
Chairman Grady stated that he and Selectman Tirrell attended a meeting on the Assisted Living Center at the Barnstable County Hospital site.
Selectman Tirrell commented on the Assisted Living Center and the Emily Bourne Fund.
Selectman Zuern spoke on the meetings she attended for the Human Services, Local Emergency Planning Committee and new school.
Selectman Covell spoke on the Archives Building, and the Mass Municipal Association meeting.
Town Administrator's Report
William R. Griffin, the Town Administrator has appointed Joseph McEachern to the position of laborer for the DPW. Lisa Marie Collette has been appointed to the Secretary II position of the Board of Health. The Health Agent has requested that the 15-day veto period be waived for Lisa Marie Collette’s position due to the early retirement program.
MOTION by Selectman Tirrell and SECONDED by Selectman Covell to waive the 15 day veto period for Lisa Marie Collette for the position of Secretary II in the Board of Health.
UNANIMOUS VOTE (4-0)
The Town Administrator also requested that the Board of Selectmen sign the Barnstable County Hospital Lease Extension through January 31, 2003.
MOTION by Selectman Tirrell and SECONDED by Selectman Covell to approve the extension of the Barnstable County Hospital Lease until January 31, 2003.
UNANIMOUS VOTE (4-0)
The Town Administrator also announced that he is one of six town managers/administrators that has been invited by the Mass Municipal Association to serve on the MMA Task Force for State and Local Finance, Service Delivery and Administration Reform.
Public Comment
Al Beinor commented on the Visitors Services Board and the age of the Senior Citizen Shellfish Permit; Charles Miller spoke on the Senior Citizen Shellfish Permit and Cumberland Farms; James Mulvey remarked on Senior Citizen Shellfish Permit; Lucia Fulco commented on Senior Citizen Shellfish Permit, Cumberland Farms hearing and procedures of the Board of Selectmen.
MOTION by Selectman Covell and SECONDED by Tirrell to adjourn.
