Approval of Minutes
MOTION by Selectman Locke and SECONDED by Selectman Zuern approve the minutes of February 11, 2003 as presented.
MOTION PASSES (4-0)
Favorable: Selectmen Grady, Tirrell, Locke and Zuern
Abstained: Selectman Covell (left the meeting early.)
Correspondence
Selectman Tirrell read all correspondence that was received.
Selectman Locke commented on the Cumberland Farms lawsuit.
Town Counsel commented on the Cumberland Farms lawsuit in regards to applying for a Special Permit from the Planning Board.
7:15 P.M. School Budget
Superintendent of Schools, Edmond LaFleur, and Chairman of School Committee, Dr. John Harrington, presented handouts to the Board of Selectmen with their FY 04 School Budget. Also present were Assistant Superintendent of Schools, Joyce Harrington, Business Administrator, Bob Watmough, and member of the School Committee Mr. Wayne Collamore.
Discussion was held.
Town Administrator, William R. Griffin, stated that he had asked the Schools to reduce their budget, which they have done, but noted that we are still waiting to hear from the State for a final decision on funds to be received.

Police Mutual Aid Agreement
Police Chief John Ford explained his reasons for the Mutual Aid Agreement with other Cape towns and requested that the Board of Selectmen sign this agreement.

MOTION by Selectman Covell and SECONDED by Selectman Tirrell to authorize the Town Administrator sign the Mutual Aid Agreement as presented tonight.
UNANIMOUS VOTE (5-0)
Impact Area Review Team Candidates
Chairman Grady stated that there are two vacancies on this committee and the Board of Selectmen can recommend whom they would like to have on this committee. However, the appointment is made by Federal Official, Bob Varney, Regional Administrator of the EPA.
The four candidates George Seaver of Cataumet, Norman McLinden of Bourne, Robert Mullennix of Bourne, and Patrick Skelly of Pocasset stated their reasons as to why they would like to serve on this committee.
Discussion was held.
MOTION by Selectman Locke and SECONDED by Selectman Covell to move the nomination of Robert Mullinnex to the Impact Area Review Committee.
UNANIMOUS VOTE (5-0)
MOTION by Selectman Zuern and SECONDED by Selectman Covell to support the nomination of George Seaver.
MOTION PASSES (4-1)

Selectman Locke thanked all of the candidates.
Open Space Committee - Grossman Property
Chairman of the Open Space Committee, Barry Johnson, requested that the Board support maintenance and improvements on Open Space property located behind the Post Office on Main Street, Buzzards Bay. Green Belt Pathway and AmeriCorp will provide land management specialists, land management plan development and physical labor for the improvements and maintenance which would provide another access to the Cape Cod Canal. He requested that an article be placed on warrant to transfer Land Bank funds for maintenance and improvements to the parcel.

MOTION by Selectman Locke and SECONDED by Selectman Covell to support the recommendation of the Open Space Committee.
UNANIMOUS VOTE (5-0)
Chairman Grady spoke of the letter received by the Conservation Commission from the Bourne Conservation Trust stating that they are offering to build a walking trail on the Open Space land, formally the DiModica property, with no expense to the town. He requested that the Bourne Conservation Trust appear before the Board of Selectmen at a future meeting to discuss their ideas.

Special Town Meeting Articles 4, 7 and 8
Article 4: Coyote Bylaw
The Finance Committee approved but with the language "putting the garbage out the night before" (which appears in two places) deleted as it does not conform to the Massachusetts Sanitary Code.
Chairman Grady read the proposed article with the amendments.
MOTION by Selectman Covell SECONDED by Selectman Zuern to approve the amendment to Article 4 to conform with the Massachusetts Sanitary Code.
MOTION PASSES (4-1)
In Favor: Selectmen Zuern, Tirrell, Grady and Tirrell
Opposed: Selectman Locke
Article 7: Motor Vehicle Junk Yard License
Town Administrator, William R. Griffin, commented on the recommendation of the Finance Committee.
Discussion was held.
MOTION by Selectman Tirrell and SECONDED by Selectman Zuern to hear the petitioner on the subject tonight before we make our recommendation.
UNANIMOUS VOTE (5-0)
Lucia Fulco of Cataumet explained the reason for this article.
Discussion was held
MOTION by Selectman Tirrell and SECONDED by Selectman Covell to recommend to Town Meeting to indefinitely postpone Article 7.
Selectman Zuern expressed her concerns on zoning.

Article 8: Firefighter Kelly McNiff
Firefighter McNiff is requesting to waive the age requirement.
Selectman Tirrell gave the background on this Article. She has been serving on the Department as a temporary and has been doing so prior to her 32nd birthday.
Discussion was held.
MOTION by Selectman Tirrell and SECONDED by Selectman Zuern the Selectmen advance a positive recommendation to Town Meeting on Article 8.

Vote on Fiscal 2004 Operating Budget
The Town Administrator stated that this is a standard budget and he will be back with changes.
MOTION by Selectman Tirrell and SECONDED by Selectman Zuern that the Board of Selectmen adopt, as its own, the preparation and the recommendation of the Town Administrator the sum of which $38,444,406.
UNANIMOUS VOTE (5-0)
Goals
The Town Administrator stated that there are 5 goals which consist of Local Comprehensive Plan, Buzzards Bay Redevelopment, Long Term Financial Planning, Public Works and ISWM and the Department of Natural Resources.

Licenses, Appointments and Use of Town Property
MOTION by Selectman Covell and SECONDED by Selectman Zuern to approve the license for Courtney Dunbury subject to the Building Inspectors approval and the completion of the Assessors Form of List.
UNANIMOUS VOTE (5-0)
A letter of resignation was received from G. Stephen Cody, the Finance Committees representative to the Capital Outlay Committee, due to illness. A letter was received from the Vice Chairman of the Finance Committee requesting that Frank DeLuca replace Mr. Cody.
MOTION by Selectman Covell and SECONDED by Selectmen Tirrell to accept the nomination of Frank DeLuca to the Capital Outlay Committee.
Selectman Tirrell stated that he appreciated Mr. Cody’s service on the Finance and Capital Outlay Committees and thanked him.

c. Muscular Dystrophy Association - Walk A Thon
MOTION by Selectman Tirrell and SECONDED by Selectman Covell move approval because the routing slip shows the application to be in order.
Selectman Tirrell discussed access to the Canal from the Buzzards Bay Railroad Bridge Parking Lot and the construction and repairs being done by the Corps of Engineers. He requested that the Corps of Engineers come before the Board with an update.

Selectmen Reports
Chairman Grady commented on the Finance Committee Meeting with the Assembly of Delegates and the Community Building Committee.
Selectman Covell spoke on Community Building Committee.
Selectman Tirrell commented on the Board of Assessor's meetings.
Selectman Zuern stated that Mr. Dennis LeBlanc will be on the Board of Selectmen’s agenda March 18th to speak on groundwater at the base, and commented on the Local Comprehensive Planning Committee meeting.
Town Administrator Reports
Town Administrator William Griffin, stated that he has appointed Rickie Tellier to his former position of Superintendent of the Department Public Works.
He stated that the Town has secured space at the First Baptist Church in Pocasset to accommodate the Council on Aging and Community Building staff.
Public Comment
Reggie Judson of Pocasset commented on fire hydrants.
Lucia Fulco of Cataumet presented the Town Administrator with information on processing passports.
