MOTION by Selectman Zuern and SECONDED by Selectman LaFarge to approve minutes of November 4, 2003 as presented.

PUBLIC COMMENT – NON AGENDA ITEMS
Richard Conron of Gray Gables commented on the recent Camp Dresser and McKee report regarding ISWM. He expressed his personal concerns.
Hamilton Whiting of Sagamore Beach thanked the Town Administrator and Board of Selectmen for their efforts getting flags put on the memorial for Jerry Cahir located on Rte 25.
Peter Meier of Buzzards Bay expressed his concerns on the Bourne Oaks Senior Housing changing status from low income housing to high priced condominiums.

Selectman LaFarge presented the correspondence that was received.
7:00 P.M. TAX CLASSIFICATION HEARING
Donna Barakauskas Principal Assessor and the Board of Assessors are requesting the Board of Selectmen retain one tax rate for all classes of property for fiscal Year 2004. She went over figures and reasons for this request.
Town Administrator, William R. Griffin, supported the single rate.
Discussion was held.
MOTION by Selectman Grady and SECONDED by Selectman LaFarge that the Board of Selectmen retains one tax rate for all classes of property for Fiscal Year 2004.

TOWN COUNSEL ROBERT TROY – PUBLIC DISCLOSURE FOR PROPOSED CONSULTANT
Roland Dupont, a former member of the Board of Selectmen and who serves on the Board of Advisers for the National Marine Life Center was the only one who submitted a bid for the National Marine Life Center’s RFP. Attorney Troy summarized his opinion on conflict of interest.
A grant of $16,000.00 was received from the state that will cover the costs of the RFP. There are guidelines for this grant. Attorney Troy asked that the Board of Selectmen vote whether to send a letter to the state Department of Housing and Community Development to make a determination whether or not the consultant can serve.
The Town Administrator explained that the National Marine Life Center is a sub grantee, as the grant would not have been received without the efforts of the town.
Sallie Riggs of the National Marine Life Center explained the process for the RFP.
Discussion was held.
MOTION by Selectman Zuern and SECONDED by Selectman Tirrell request a waiver from the grant guidelines from the State (Mass Department of Housing and Community Development) and put his name (Roland Dupont) forward.
AMENDED MOTION by Selectman Zuern and SECONDED by Selectman Tirrell (that the filing with the State of Mass DHCD) include the disclosure.

7:30 P.M. POLE HEARING – JONATHAN BOURNE DRIVE – NStar
Barbara Trocchi of Nstar is requesting permission to install and maintain cable and conduit in Pocasset on Jonathan Bourne Drive for the purpose to provide underground electric service at 51 Jonathan Bourne Drive, Paul Mederios, owner.
Discussion was held.
MOTION by Selectman Zuern and SECONDED by Selectman LaFarge to approve the request (of Nstar) to install the cable and conduit in Pocasset on 51 Jonathan Bourne.

7:40 P.M. POLE HEARING – NIGHTINGALE POND ROAD - VERIZON
Ken Horn of Verizon is requesting 360 feet of conduit along Nightingale Pond Road. The work is necessary to provide service to new homes on Deseret Drive.
Steve Jenkowskas an abutter of 2 Nightingale Pond Road questioned the impact on his property and the hours the work will be done.
James Mulvey of Buzzards Bay requested that the utility companies coordinate work.

MOTION by Selectman Grady and SECONDED by Selectman LaFarge to approve the request of Verizon as indicated on the plans (360 feet of conduit along Nightingale Pond Road to provide service to new homes on Deseret Drive) provided that all construction work not commence prior to 8:30 a.m.

CONSERVATION RESTRICTIONS: 133 SOUTH ROAD AND WINGS NECK CONSERVATION
Heather Lanza of the Orenda Wildlife Trust, Inc. a charitable 501(c)(3) organization went over the two Conservation Restrictions. One being at 133 South Road with approximately 2.06 acres, forested and proximal to numerous parcels with current applicable Conservation Restrictions and has been recommend to be held in perpetuity. The second being Wings Neck Conservation Foundation consisting of approximately 2.45 acres on South Road also to be retained in perpetuity. The Conservation Commission and state have recommended positive approval.

MOTION by Selectman Grady and SECONDED by Selectman LaFarge to approve the Conservation Restrictions for the benefit of the Orenda Wildlife Trust Inc. a charitable 501(c)(3) organization two (2) parcels of land as more fully described in letter from the Conservation Commission dated October 23, 2003 to the Town Administrator they being parcels 133 on South Road on Wings Neck with a total of approximately 4.5 acres in two parcels.

MOTION by Selectman Grady and SECONDED by Selectman Zuern to approve the recommended proposal fees as set forth in the Town Administrator’s memorandum to us and that all of said licenses and permit fees become effective January 1, 2004.

APPOINTMENTS – USE OF TOWN PROPERTY
There were three applicants – William Locke of Cataumet – Richard LaFarge of Bourne and Linda Zuern of Cataumet.
Selectman Zuern withdrew her name and stated her reasons.
Selectman LaFarge stated his reasons why he would like to serve on this committee.
A roll call vote was taken:
Selectmen Tirrell, LaFarge and Grady voted for Richard LaFarge.
Selectmen Zuern and Barlow voted for William Locke.
Richard LaFarge was chosen.
b. 2004 Scallop Festival
A request was received by the Canal Chamber of Commerce to use the Buzzards Bay Park for their annual Scallop Festival September 8th through the 24th, 2004. There is a lease agreement that has been signed in the past and would like to have signed again for this event.
Selectman Grady stated that he would like to add to the Lease Agreement "No amplified music will be played prior to noon time on any Sunday during the license period".
MOTION by Selectman Grady and SECONDED by Selectman Zuern to approve the license as requested (by the Chamber of Commerce for their 2004 Scallop Festival to be held September 8th through the 24th, 2004 with adding the amendment "No amplified music will be played on Sunday mornings prior to noon."

SELECTMEN REPORTS
Selectman Zuern spoke on Cable Advisory Committee, Senior Management Board, Tour of MMR, Pollution Task Force, Landfill Open House, RIF Program (Reading is Fundamental) where she read a story to Sue Silva’s 3rd grade reading class at Peebles School and C & D (Construction and Demolition) not to be taken at the landfill.
Selectman Zuern spoke to Mashpee Selectman Chuckie Greene regarding the C & D at the landfill. He would like to pursue efforts, state wide, to help the Town of Bourne get funding to build the processing facility in the amount of $8 million dollars.

The Board of Selectman supported the idea of Mashpee Selectman Chuckie Greene to pursue his efforts to get other towns and/or the state to finance a new C & D processing center at the Landfill.
Selectmen LaFarge and Grady did not have reports.
Chairman Tirrell commented on Tour of the landfill, RIF reading at all the first grade classes at Hoxie School, Cape Cod Selectmen’s and Councilors monthly meeting, and Town Administrator’s presentation to Finance Committee, and presented a citation to Lorraine Burgess for 45 years of service.
Selectman Barlow spoke on Property Classification and oyster season.
TOWN ADMINISTRATOR REPORTS
He will get back to the Board with a date for a public hearing on ISWM.
Appointments: A transfer for Operator 1 position from DPW to ISWM John Howard; (2) Laborers positions at ISWM Jessica Glenn and Michael Mulcahy; and (1) Laborer position of Paul Larsen to the DPW.
PUBLIC COMMENT
Gerry Collette of Buzzards Bay commented on sand being removed from ISWM.
The next meeting of the Board will be held on November 25, 2003.
