Correspondence

Selectman LaFarge went over all correspondence received.

 

Massachusetts Maritime Academy – Report on Bourne Marina

This item was heard later in meeting due to the arrival of all parties.

Cape Cod Cranberry Corp Technical Title Clearing

Town Administrator, William R. Griffin, stated reasons why this Technical Title Clearing needed to be signed.

MOTION by Selectman Grady and SECONDED by Selectman Zuern that we approve and execute the order of taking as prepared by Town Counsel as it relates to the real estate that we are taking from the Cape American Cranberry Corp and for the purpose of Open Space acquisition.

Selectman Barlow stated that he is an abutter to the property and would not participate.

MOTION PASSES (4-0-1)

Massachusetts Maritime Academy – Report on the Bourne Marina

All parties have arrived.

Tom McKenzie, the former Marina Manager from the Massachusetts Maritime Academy for the Bourne Marina, presented the Board of Selectmen with a survey they had done. He pointed out what work needs to be done now and in the future.

The new Marina Manager, Robert Dawley, of the Department of Natural Resources met with Mr. McKenzie and went over the entire facility.

Selectmen Tirrell and Barlow complimented Mr. McKenzie on the

service he has performed at the Bourne Marina for the past 6 years.

Private Roads

Chairman Tirrell commented on the research that was done by the Town Administrator on the program for the town taking ownership of private roads.

Town Administrator, William R. Griffin, stated what would need to be done in order for the town to take over ownership of private roads. He requested a professional surveyed plan be done on each road presented, a bylaw setting a standard and process so this program may begin and an exception for a road acceptance. He explained the different options available on financing, costs to abutters for survey, acceptance, layout and reconstruction of the way. Betterment process was also discussed as a way to aid the homeowners with costs.

He went over the programs that Falmouth, Plymouth and Yarmouth have done and the options they used.

William R. Griffin suggested that his proposal be sent to Town Counsel and the Planning Board for their review as well as having a Working Group formed.

Selectman Grady commented on the program and complimented the Town Administrator on his work done on the proposal.

Selectman Barlow commented on how the town handled this process in the past and Sewer Betterments that were given when that system was installed.

Selectman LaFarge stated that the private road he lives on is in good shape and would like to have it accepted now instead of waiting until it is in poor condition and costing much more.

Craig Carchidi of The Cataumet Hills Association, a development consisting of 37 homes with three cul de sacs stated that they are having numerous drainage problems and the roads are in very poor condition.

Jennifer Chisser of the Weldon Park Community Association commented on the 7 miles of roads consisting of 13 roadways and 11 cul-de-sacs, one entrance/exit, age of development, condition of roads, paperwork/petitions needed for acceptance and drainage issues.

Shawn Hite, 5 Winston Ave, Weldon Park commented on Chapter 90 funds and costs to set up this program.

Bill Kempton, 14 Sir Lancelot Drive, Weldon Park spoke of increasing the amount of bonds from developers, drainage problems, and accepting new roads with less cost to the Town.

Charles Miller of Monument Beach commented on easements for water drainage and list of accepted streets.

James Mulvey of Buzzards Bay commented on time frame if bylaw is passed.

MOTION by Selectman Grady and SECONDED by Selectman Barlow that the suggestions as proposed by the Town Administrator (1. Forward this report to the Planning Board and Town Counsel for its comment and suggestions; 2. Begin preparation of Road Acceptance & Reconstruction Bylaw for consideration by the 2004 Annual Town Meeting; 3. Begin preparation of a Betterment Bylaw for consideration by the 2004 Annual Town Meeting; 4. Consider the appropriation of a sum of money at the 2004 Annual Town Meeting to be used for engineering and survey services for those roads selected for possible acceptance at the 2005 Annual Town Meeting; 5. Create a special committee composed of representatives of the Board of Selectmen, Planning Board, Planning Department, Department of Public Works and Engineering Department to develop specific recommendations on the issues identified in this report, especially the selection criteria to prioritize roads for acceptance) be implemented and that preparations for their implementation begin to take place under the direction of the Town Administrator.

Use of Town Property – Road Name Request – Appointments

National Multiple Sclerosis Society – Great Mass Getaway MS Bike Tour

A letter was received from the National Multiple Sclerosis Society for their annual Bike Tour to be held on June 26 and 27, 2004.

Discussion was held

MOTION by Selectman Grady and SECONDED by Selectman LaFarge to approve the request of the National Multiple Sclerosis Society to conduct their Bike Tour on Saturday June 26 and Sunday June 27, 2004 in accordance with their application provided. However, that it is noted that the Police Department and Highway Department get a more specific delineation of the town roads which would be utilized by them and the approximate times of said utilization and further that it is understood that our approval does not include any approvals concerning the use of the Bourne Bridge or any other locations that are under the jurisdiction of the Mass Highway Department or the Army Corp of Engineers. And further that any signage for direction purposes placed on town property or any other property by the applicant shall be removed within 48 hours of the event.

Cape Cod Road Runners – Winter Fun Run

Mr. Bob Burt submitted a letter requesting use of town ways for the Cape Cod Road Runners annual Winter Fun Run on January 4, 2004.

MOTION by Selectman Grady and SECONDED by Selectman LaFarge to approve the application of the Cape Cod Road Runners – Winter Fun Run for January 4, 2004 between the hours of 10:30 a.m. and noon for a five mile course as set forth and described in their letter of application dated November 7, 2003.

Road Names

Motor Way

A request for the road name of Motor Way was received from Paula Smith of Bridgewater. There is a new subdivision "MacArthur Boulevard Business Center" located off MacArthur Blvd.

Selectman Grady questioned if the Planning Board had approved subdivision.

Discussion was held.

MOTION by Selectman Grady and SECONDED by Selectman Zuern we table this for a week or until our next meeting for the purpose of checking into the status of the subdivision with the Planning Board.

Recycling Committee

A letter of interest was received from Helen Lyn Dazell of Cataumet.

MOTION by Selectman LaFarge and SECONDED by Selectman Zuern to appoint Helen Lyn Dalzell of Cataumet to the Recycling Committee.

Luciani’s Enterprises d/b/a Ma’s Restaurant

Peter Luciani, owner, stated that has received all licenses and permits and now would like his Common Victualler’s license to operate.

Discussion was held.

MOTION by Selectman LaFarge and SECONDED by Selectman Zuern to approve the Common Victualler’s License for Luciani Enterprises d/b/a Ma’s Restaurant

Selectmen Reports

Selectmen Barlow, Zuern and LaFarge had no reports.

Chairman Tirrell commented on the Director of the Council on Aging recovering from surgery.

Selectman Grady stated that the next Selectmen’s Meeting to be held on December 9, 2003 at the High School regarding ISWM.

Town Administrator Reports

Dudley Jenson would like to implement a pedestrian and bike access to the Railroad Bridge like it was years ago. Mr. Jensen seeks the Board of Selectmen’s endorsement and would like them to approach the Army Corp of Engineers to see if this can be done.

There was no opposition and the Town Administrator will pursue.

Public Comment

Jerry Collette of Buzzards Bay commented on the schedule of the Selectmen’s meetings.

Charles Miller of Monument Beach commented on beach stickers.
