Public Comment – Non Agenda Items

Joe Agrillo expressed concern about the cost of staying in the Cape Cod Commission.  It costs around $130K per year.  This is just the beginning of the cost to Cape Cod, he said.  Once the law is laid down and the contractors are told what they have to spend, it puts a whole new light on the cost of developing property.  He asked if the Board had any future plans of withdrawing from the Cape Cod Commission? 

TA Guerino said that two weeks ago the Board requested that a meeting be set up at the Bourne High School Auditorium with the Planning Board to discuss this matter.  The tentative date is Tuesday, April 18th, from 7-9:30 p.m.  The Commission will be invited, along with the Planning Board, and the information Mr. Agrillo is seeking may be obtained at that meeting as there will be a full cost discussion. 

Chairman Cheli said that the Town of Sandwich and other towns in the area are looking into withdrawing from the Commission as well.

Mr. Agrillo stated that the Town of Bourne voted not to participate in the Commission but they were forced into it.  He was one of the people who put out signs saying not to vote for it, so it is known how he feels about it.

He went on to speak about the Override.  We have to be doing something to be looking at another 2 ½ override.  How much money will this cost in the next year or two?  This should be publicized and be part of the Selectmen’s Agenda for next year.

Correspondence

Selectman LaFarge read the correspondence.

TA Guerino followed up on the letter from Ms. Donovan requesting public information.  He met with John Johnson to narrow the scope of the request and he has sent a memo to all department heads with the request.

On behalf of the Town of Bourne, Selectman G. Barlow presented Selectman W.T. Barlow with a plaque thanking him for all his many years of community service.  He wished him health and good fortune.  The audience applauded, but Selectman W.T. Barlow declined giving a speech.

Capital Expense Working Group

TA Guerino thanked the Chairman for putting this item at the front of the agenda and said that it was in response to putting together a Capital Outlay and long-term financial expenditure working group as brought before the Board and himself several weeks ago.  The make-up of the working group would consist of members of the Capital Budget Committee, Finance Committee, Board of Selectmen, School Department, large and small department leaders, Finance Director and Town Administrator.  Each elected and appointed Board cited herein will appoint it’s own representative. 

The working group will be charged with reviewing the long-term capital needs of the community, documenting the inventory of such needs, justification for such needs, identifying municipal and financial implications both short and long-term to the community, research best practices amongst other communities within the Commonwealth and hear from experts on capital and financial trends in the public sector.  The working group will establish priorities for accomplishment of the group’s work and report to the Capital Budget Committee and Board of Selectmen quarterly with its progress. 

The group will strive to establish various “bands” of capital needs with initial costs and replacement schedules.  Examples include Capital needs for rolling stock, facilities, major repair, facility replacement, technology needs and regular ongoing but infrequent purchases, assimilating all costs, re-prioritizing and creating working capital document to be submitted to the Capital Budget Committee for amendment and recommendation to the Board of Selectmen.

The working group shall have the ability to call on boards and departments in the effort to establish the needs and priorities of capital equipment, facilities and financial mechanisms.  It shall have no other independent authority and shall be responsible for reporting findings and recommendations to the Capital Budget Committee, pursuant to Sections 7-2 and 7-3 of the Town of Bourne Charter, inasmuch as long term capital planning and costs so associated directly impact the provisions of Section 7-3 (Long-Term Financial Forecast).

The proposed initial term is one year from April 1st.  This working group will be subject to the provisions of the Open Meeting Law and internalizes it more to a local knowledge base and requires it to report back to the Committee that is established to do capital budgeting as opposed to being a separate and distinct little organization.  He expressed hope that the Board would move forward on this.

TA Guerino went on to say that the Capital Budget Committee is the responsible party for bringing Capital expenditures to the Board of Selectmen.  It’s up to the Capital Budget Committee to make the final determination on what comes forward to the Board of Selectmen and ultimately the Town Meeting.

Selectman G. Barlow, a member of the Capital Outlay Committee, said it was really needed because they deal with a five-year plan and department heads come to them with yearly requests.  While they deal with requests that are before them, they don’t deal with long-term plans.  They should, but they can’t.  A well-rounded group of people from all the different entities is needed to review everything and get things together for them.  The Capital Outlay Committee deals with one year of a five-year plan.  It doesn’t include building a new police or fire station.  There isn’t enough money to do that and in order to do that, they need other people from the school, fire and police departments to not only say we need the facility, but to find a way to get the money as well.  When Chief Klueber said he needed a new fire station, and “by the way I have the money”, that was a big help.

Selectman W.T. Barlow asked if as Executive Order had been written up?  This would be Executive Order Two of ’06 (02-06).

TA Guerino said he would have it written up in Executive Format for the Board for the next meeting.

Selectman W.T. Barlow MOTIONED to approve the Executive Order for the Capital Outlay Long-Term Financial and Expenditure Working Group. Selectman Zuern SECONDED.  UNANIMOUS.

Disposition of Mini-Pumper 

The Brownfield Volunteer Fire Company of Maine asked to have their request to be considered for the donation of the 1979 Ford F350 Mini-Pumper rescinded since there were opposing opinions regarding the vehicle and they had no wish to cause disagreement. 

Town Counsel provided legal opinion stating the Board could dispose of town property as deemed in the best interests of the Town.  The Town By-Law says the Selectmen may dispose of it or put it to auction.  Selectman G. Barlow said that the Town of Wareham sells their surplus equipment on Ebay.  TA Guerino will meet with DPW Superintendent Rickie Tellier to discuss other options.

Selectman W.T. Barlow said that the Mini-Pumper has a value and the Board does not have the right to give assets away.  The money belongs to the Town of Bourne.  The Board of Selectmen were the only ones who declared the Mini-Pumper surplus.  The point of inventory control is that nothing is let go.

Marconi Club – One Day Liquor License, All-Alcoholic

Selectman Zuern MOTIONED to approve Marconi Club’s request for a One Day Liquor License on July 16, 2006 at the Boosters Club.  Selectman LaFarge SECONDED, UNANIMOUS.

Selectman G. Barlow made formal note that he abstained from the voting on the liquor licenses.

Street Lighting Committee Appointment – Robert E. Schofield

Capital Improvement Plan

TA Guerino said there was one adjustment to the Capital Plan that the Board originally saw.  It will be shown in written format at next week’s meeting.  A request came in for the Special Town Meeting for $20,000 for repair of dinghy docks at Hen Cove, Barlow’s Landing and Monument Beach.  Instead of having a separate article it will be included in the Annual Town Meeting on the Capital Plan.   It came in too late for the Capital Budget Committee to act on it for their recommendations to the Board but after speaking with the Chairman and other members of the Committee it made sense to incorporate it into the Capital Plan.

Zoning Enforcement Officer 

There’s an article that the Planning Board will be hearing on the 13th.  An Assistant Zoning Code Enforcement Officer position will be established and an existing by-law will have to be amended in order to do this and it will be heard on the 13th.  A job description needs to be written and this person will assist Roger LaPorte.

Town Administrator’s Report 

The press release for the Zoning Board of Appeals and the advertisement for the Citizen Representative for DNR committee are due back in a few weeks.  Reports from the Shore and Harbor Committee and the Shellfish Working Group as to whom they would appoint to this working group have been received.  The Finance Committee was working on it last night.  The Citizen Representative will be appointed by the Board.

Selectman G. Barlow said that although the Board of Health doesn’t have to have a seat on the Committee, they want direct access to it since there are animal control issues that need to be addressed. 

TA Guerino asked that for the last quarter, departments please stick to 1/12th of their appropriation since fiscal times are still snug.

A breakdown of the additional Police Officers was distributed to the Selectmen.  With the inclusion of the Police Officers they remained within the 6% directive imposed by the Board.  Revenues were increased; motor vehicle excise is now at $2375.  There was discussion to level-fund it to make it as conservative as possible.  In going back to FY05, they took the actual amount brought in and utilized the figure from FY05 (FY06 wasn’t available) and anticipate an increase of 1.25%.  The only other increase to the line has to do with available funds.  It’s a reduction from last year but they have received a check for $32K.   All the Capital Outlay articles, including the $20K, are within the Sources and Uses of funds and stayed under the 6% as dictated by the Board of Selectmen.

Selectman W.T. Barlow requested that TA Guerino prepare for the Health Insurance year to date.  TA Guerino said it was handed out a few weeks ago and they are on track.  The insurance has been raised from 6.5 to 7.375 million of the next year as the Town’s share. There will be a discussion with the Board once they hear back from the Underwriters as to the stop-loss.  He said that updates would be provided to the Board on a more frequent basis.

TA Guerino expressed his gratitude and thanks to Selectman W.T. Barlow for his support, professional and political guidance and his high degree of friendship.

Selectman Zuern asked about other committee openings and are they listed in the paper?

TA Guerino said the Finance Committee recently appointed a new member named
Mark DeCicco who took Joe Gordon’s position.  They are now at a compliment of 13 out of a possible 15 and that he would look into the matter of listings.

Selectmen’s Reports 

Selectman Zuern went to the LEPC meeting on Monday and they are still looking for CERT trainers.  Their training sessions will be on Wednesdays from 6 to 9 p.m. at the Barnstable County Jail for eight weeks.  For more information call Dan at (508) 563-4320.  During the Town Meeting, Health Agent Cynthia Coffin and others plan to have information out on the table for what to do in an emergency. 

There was a final vote taken on the $812,243 for the school project at the School Building Meeting on Thursday.  Ian Fischer from the Daedalus project spoke about the differences in cost estimates.  Mistakes were made in the first estimates and she has new information for anyone interested.  Every month delaying the building of the school costs $125K.

She visited the BBVA and discussed the Whale Trail Event.  Ernie Ford will be painting this year’s whale.  In conjunction with this, there will be a Whaling Captain’s Dinner at the Beachmoor.  A person at each table will be representing one of the whaling families in the community.  There are twelve altogether and the Barlows are one of those families.  There will be members from the Historical Society who will be dressed up and representing some of those characters and there will be an auction.  Tickets are $35 each.  She also spoke about the 5K Road race for Keith Songer. 

In addition, she attended Candidates Night on Wednesday and wanted to clarify that none of the Selectmen had attended the Cape Cod Commission meeting a couple of weeks ago.

Selectman Zuern also thanked Selectman W.T Barlow for his contributions to the Board.  Although they had not always agreed, he never took anything personally.  She wished him the best and opined that they might see more of him in the future than he thinks.

Selectman G. Barlow attended the School Committee meeting last Wednesday night. There were awards for volunteers.  In regard to Monument Beach Marina, $100K was approved for repairs and almost half the repairs have already been made.  After the storm, the grassy area at Monument Beach was looking pretty sad but the DPW did a wonderful job cleaning it up and now it is an asset to the community.  He thanked Rickie Tellier and all the crew at the DPW for their efforts.  He reminded folks to vote on Wednesday.

Selectman Lafarge encouraged the public to vote on Election Day as well.

Chairman Cheli said it was a privilege to serve with Selectman W.T. Barlow and called him a “walking historian for the Town of Bourne” as well as a wealth of information

Selectman W.T. Barlow said that every member of the Board cares tremendously about the Town, has a vision and wants to see it go forward.  He said it’s been a privilege to work with every one of them.  He thanked TA Guerino, Dick Anderson behind the camera, and Reporters Paul Gately and Diane Barth who strove to report the Board accurately.  He is very grateful for the opportunity to have served the Town of Bourne.
