Moment of
Silence/Salute the Flag
Approval of Minutes
Selectman Conron MOVED and SECONDED by Selectman Ford to approve the Minutes of June 26, 2007 as presented and amended. VOTE 4-0-1 with abstention from Selectman Zuern.
Announcements
Selectman Conron noted the summer’s soiree of the Bourne Historical Society on August 12, 2007 at 5:30 pm – 8:00 pm.
Public Comment –
Non-Agenda Items
Kathleen Donovan thanked Mr. & Mrs. Carrara for the 4th of July parade in Bourne.
Jeff Avery (owner of Buzzards Bay Theater) also thanked the Carraras for the parade. He also noted bringing more people to Main Street, Buzzards Bay. Discussion held.
Joseph Agrillo requested a PA system as an investment to the town. He also noted the liquor licenses granted and the message it was sending out and noted taking it under consideration.
Sally Riggs noted the Bourne Development Corporation Contracts with Village Planning Consultants schedules public participation Workshop on July 24, 2007 (9 am -4pm), July 25, 2007 (9 am-9 pm) and July 26, 2007 (9 am-2 pm). On the last day of the workshop, the BFDC and Santac (Planning & Landscape Architecture, PC) will host a reception at the Beachmoor Inn & Restaurant from 5 pm – 6 pm to report on the discussions.
Licenses/Permits
TA Guerino noted continuance from June 26, 2007 Selectmen’s meeting, as there were questions relative to the set up of the outside eating and serving/pouring areas. Changes were reviewed by the Building Inspector, Police Department and the Planning Board Chm., all of whom visited site.
Joseph Pagliarani (Director, Sagamore Inn) and Lt. Tavares (Police Department) noted changes.
Discussion held.
Selectman Sloniecki MOVED and SECONDED by Selectman Ford to approve the requested amendment to Sagamore Inn License, and to include the remarks made by the Police Department for license issues. VOTE 5-0.
Selectman Ford MOVED and SECONDED by Selectman Sloniecki to accept and approve the One Day Liquor license. VOTE 5-0.
Selectman Sloniecki MOVED and SECONDED by Selectman Ford to accept and approve the One Day Liquor license. VOTE 5-0.
Selectman Ford MOVED and SECONDED by Selectman Zuern to accept and approve the Common Victualer license. VOTE 5-0.
TA Guerino noted former Selectman Harrington moved to approve the PAN-MASS challenge sign and route in a previous meeting.
CORI Policy Review
Krissane Caron and Lt. Tavares reviewed and commented/suggested changes in Policy as approved for content and form by Town Counsel.
Chm. Mealy noted this is to establish a policy required by Mass. Gen. Laws requiring all organizations having access to children to do background checks on employees and volunteers within the town.
Discussion held.
Public comment on having CORI certified people running the checks. It was noted that the CORI checks are not tied into the Department of Social Services database and suggestion of questions to include if applicant was involved with the DSS.
Selectman Ford noted to exclude Recreation Director on Appeals Committee and to include the Town Administrator or his designee.
Selectman Sloniecki MOVED and SECONDED by Selectman Zuern to approve and adopt the CORI Policy Review as amended. VOTE 5-0.
Landfill Residential
area hours of operation
TA Guerino noted reviewing hours of operation with Brent Goins, understanding the sensitivity to residents and seasonal residents. This equates to a total of $27,000 in savings over the course of the year.
Brent Goins noted the new hours of operation will allow time to complete maintenance, an issue raised several years ago.
TA Guerino and ISWM General Manager recommend reduction of Residential Recycling area hours by closing on Tuesdays and Wednesdays. Weekend hours would remain the same.
Discussion held.
Public comment on proposal and is a place to bring in revenue to the town.
Roland Dupont commented on to not change the hours of operation to the residential recycling center.
Joseph Agrillo also noted to not change the hours of operation.
TA Guerino suggested implementing between Labor Day through May 31, 2008 and come back with a review at that point.
Selectman Conron MOVED and SECONDED by Selectman Mealy to accept and adopt the Town Administrator/ISWM General Manager’s recommendations of reduction of Residential Recycling area hours, beginning the Tuesday after Labor Day, 2007 through the end of May, 2008. VOTE 2-3 with opposing votes from Selectmen Zuern, Ford and Sloniecki.
Selectman Ford MOVED and SECONDED Selectman Sloniecki to keep hours of operation of the residential recycling center as is. VOTE 2-3 with opposing votes from Selectmen Mealy, Zuern and Conron.
Selectman Zuern MOVED
and SECONDED by Selectman Conron to
close the residential recycling center Tuesday, after Labor Day through April
1, 2008. VOTE 3-2 with opposing votes from Selectmen Ford and Sloniecki.
Discuss tonnage at
ISWM for granting a waiver
TA Guerino recommends the Board approve (retroactively) waiver of Tonnage requirement, due to humpback whale disposal, to include an additional four (4) tons.
Jim Mulvey noted his disagreement of towing the whale to the Town of Bourne landfill.
Selectman Zuern MOVED and SECONDED by Selectman Conron to approve (retroactively) waiver of Tonnage requirement to include an additional four (4) tons. VOTE 5-0.
Selectman Zuern MOVED and SECONDED by Selectman Conron to allow the Town Administrator and the Management staff at ISWM to make decisions as they arise. VOTE 5-0.
Appointments
TA Guerino noted Mr. Legg has withdrawn his name from consideration.
Selectman Ford MOVED and SECONDED by Selectman Sloniecki to re-appoint Hunter Scott and Richard Libin to the Shore & Harbor Committee. VOTE 5-0.
Selectman Ford MOVED and SECONDED by Selectman Sloniecki to appoint Arlene Cardoza as member of the Register of Voters. VOTE 5-0.
Selectman Ford MOVED and SECONDED by Selectman Conron to re-appoint Robert Schoffield, Bill Locke, Diane Flynn, Angie MacLeod and Kathleen Donovan to the Cable Television Advisory Committee. VOTE 5-0.
TA Guerino noted to defer until next meeting (Peter Meier).
Selectman Ford MOVED and SECONDED by Selectman Zuern to re-appoint Robert Schoffield as Bourne’s Representative to the Cape Light Compact. VOTE 5-0.
Selectman Zuern MOVED and SECONDED by Selectman Sloniecki to re-appoint Coreen Moore to the Central Information and Liaison Officer for Development. VOTE 5-0.
Per Coreen Moore’s letter, Selectman Conron MOVED and SECONDED by Selectman Ford to re-appoint Coreen Moore on the Local Comprehensive Committee, Open Space, Housing Action Committee and Housing Partnership. VOTE 5-0.
Selectman Conron MOVED and SECONDED by Selectman Ford to re-appoint Robert Schoffield to the Street & Traffic Light Committee. VOTE 5-0.
Town Administrator’s
Report
TA Guerino noted several appointments (Assistant Assessor, Director of Business at ISWM and DNR Director) per e-mail. He is requesting the Board approve the appointments and waive the 15 day period.
Selectman Sloniecki MOVED and SECONDED by Selectman Zuern to approve the appointments of Assistant Assessor, Director of Business/ISWM and DNR Director and to waive the 15 day period. VOTE 5-0.
TA Guerino thanked Mr. & Mrs. Carrara for the 4th of July parade. He also thanked the Police and Fire Departments for their assistance to the parade.
TA Guerino noted material on the lower/mid Cape where area towns (Falmouth, Sandwich and Bourne) are looking to copying negotiation contracts on cable services. This information will be forwarded to the Cable Advisory Committee before making a recommendation to the Board of Selectmen. (Selectman Zuern noted looking back into the cost).
Personnel reviews will be conducted in August.
Public Forum will be held on July 25, 2007 at the Community Center for hiring the Fire Chief. A consultant available interview process will begin afterwards.
Other Selectmen
Business
Chm. Mealy noted ZBA Chm.’s letter for the Board of Selectmen’s recommendation regarding Canalside.
Discussion held.
TA Guerino noted revenue account from Comcast. Finance Director will appropriate funds, as expended monies will be replenished at Special Town Meeting. Equipment needed are a DVD burner; 8 microphones (5-1 ear and 2 spares) – moving forward.
Selectmen’s Report
Selectman Zuern attended the dedication Doran Park on Sandwich Road on July 8, 2007.
Selectman Zuern attended the Buzzards Bay Village meeting this morning.
Selectman Zuern noted the Irwin’s letter stating interest in purchasing town-owned land adjacent to their property.
Selectman Ford noted George Seaver correspondence regarding sewer and nitrogen – Phinney’s Harbor – and to possibly get him involved, for a different perspective. A copy of correspondence was handed to Jim Mulvey as a Pollution Task Force member.
Selectman Ford attended the Cubellis celebration as representative of the Board for 70th anniversary.
Chm. Mealy and Selectman Zuern and Ford thanked the Carrara’s for their efforts on the 4th of July parade. Chm. Mealy also thanked Susan Gifford and Matt Patrick for attending the parade.
Correspondence
Selectman Conron reviewed the correspondence. All correspondence is one file in the Town Administrator’s Office for review.
Comments Correspondence
TA Guerino noted update on the correspondence:
a) 188 County Road – Atty. Troy noted documents recorded at Barnstable County.
b) Town of Bourne Charter – State Representative Perry’s Office noted the name of Goldman for the Third Reading. Goldman’s staff indicated bill has been transferred to House Counsel for review (normal course) and a representative will contact TA Guerino to try to move out of committee.
TA Guerino noted forwarding Schooner pass information to the ZBA Chm.
