Meeting Called to Order
Meeting called to order at 7:00 pm.
Moment of Silence/Salute the Flag
Approval of Minutes
Selectman Conron MOVED and SECONDED by Selectman
Sloniecki to approve minutes of January 29, 2008 as written. VOTE 3-0-1 with one abstention from
Chm. Mealy.
Announcements
Several announcements were made of upcoming events.
Public Comment – Non-Agenda
Items
Sally Riggs (BFDC) announced Bourne Financial Development Corporation
partnership with private landowner.
She also noted the Partner’s vision is a technology camp to support
development of Alternative Energy and other technologies.
Chm. Mealy requested Sally Riggs come before the Board to give a
presentation.
Selectman Zuern MOVED and SECONDED by Selectman Sloniecki
to recess regular meeting at 7:10 pm and go into Joint Meeting with Trustees of
Veterans’ Memorial Community Building Center.
Roll call – UNANIMOUS VOTE.
Selectman Sloniecki MOVED
and SECONDED by Selectman Zuern to reconvene regular Selectman meeting
at 7:30 pm. Roll call – UNANIMOUS
VOTE.
TA Guerino requested to defer the Selectmen’s/TA Budget until next
meeting.
Buzzards Bay Park (Jeff Luce) BBVA/BFDC
Handout of Bridge Park and discussed long and near term items: pavilion;
dog park; seasonal skating rink; playground; and projection screen on side of
National Marine Center. Jeff Luce is
asking the Board of Selectmen for support to form a working group.
Licenses/Permits/Appointments:
a. Cape Boulevard – reduction in seating capacity – rescheduled
b. Redcap Corps LLC d/b/a Green Shuttle of Cape Cod - Public Livery
Selectman Conron MOVED and SECONDED
by Selectman Zuern to approve Green Shuttle of Cape Cod’s request of three
additional vehicles with conditions of Board of Health (no car/engine repair on
site); Planning Board (no more than 5 vehicles stored on property – no repair
of vehicles to be done on site); and Police Department (all vehicles be
inspected by Sgt. Farrell). VOTE 5-0.
Courtyard Public Forum
Jay & Paula Miller (Courtyard)
noted coming to an agreement with his attorneys and stated he is willing to
shut all outside music down at 12:30 pm seven days a week, and no amplification
outside.
Jay Miller expressed willingness to
work with the neighbors. He also
admitted letter from Kevin Buckley to the record re: cutting back volume from
outdoor music.
Selectman Ford noted for the record
the public can call Police Department re: complaints.
Peter Mack, neighbor, commented on
several complaints he made re: the Courtyard music and parking on the
street. He suggested no music outside.
Ginger Buckley, neighbor, commented
on waking up to the sound of music and noted wanting to cooperate with the
Courtyard. She suggested no music
outside.
David Mash, neighbor, commented on
his complaints re: music for the past 13 years. He also noted calls are not being recorded with the Police
Department.
Martin McCabe, neighbor, although
not living in close proximity, commented on never having an issue with the
outside music.
Sean Patterson noted being bass and
drums player, inquired when last complaint was. TA Guerino noted it was at 5:24 pm on July 9, 2007. Mr. Patterson continued to ask if there were
any more complaints. Sgt. Farrell noted
no more complaints.
Kevin Buckley, neighbor, commented
on wanting to work with Mr. & Mrs. Miller.
He went to Town Hall and was told there is nothing that can be
done. Since he was not told to file
complaint with the Police Department, complaints were not recorded. He would like terms of license changed and
noted would like all music moved indoors.
Norma White, neighbor, commented on
husband working early in the morning and having to keep windows shut due to
music.
Jay Miller expressed concern of
amount of calls going to the Police Department this summer.
Carl Pratt, neighbor, commented on
music and soliciting beyond 1:00 pm.
Kelly Morley, neighbor, commented on
complaints she made to the Town Hall.
She believes there should be a written and enforceable agreement between
the Town and Courtyard.
Peter Mack suggested making
complaints to Town Hall, rather than the Police Department, and liked written
agreement.
Chm. Mealy ask community to get
together and work outside legal system and put in written form. He also noted approaching Town Counsel re:
modification of license and enforcing said written agreement.
Selectman Zuern suggested holding a
public hearing and let the Board of Selectmen set standards.
Selectman Ford noted the Courtyard
had no pouring liquor violations. He
also commented on only establishment in the area, but neighborhood has right
for some quietness at late night.
Selectman Conron commented on
minutes in December was to post a hearing and determine restrictions.
Chm. Mealy noted next step is
notification by letter after consulting Town Counsel.
Correspondence
Selectman Conron reviewed the correspondence. All correspondence is on file in the Town Administrator’s Office.
TA Guerino noted the County re:
Chapter 193 of the Acts of 2004, an act further regulating public construction
in Commonwealth is correct.
TA Guerino also commented on
Comcast’s submittal of a copy of Form 500 for 2007.
Selectman Conron MOVED and SECONDED
by Selectman Ford for Town Administrator to write letter in support re: Act
further regulating public construction in the Commonwealth. VOTE 5-0.
Proclamation - Mass Recycle
Chm. Mealy read into record said proclamation.
Selectman Zuern MOVED and SECONDED by Selectman Sloniecki to adopt the Resolution in Support of the Mass Recycles Paper Campaign. VOTE 5-0.
Selectman Zuern also suggested TA Guerino notify the schools for said campaign.
Town Administrator's Evaluation Document
Selectman Conron reviewed the evaluation document.
TA Guerino requested Selectmen with a full year experience participate in said evaluation document.
Selectman Conron requested TA Guerino put on agenda for next week.
Town Administrator's Report
TA Guerino suggested establishing a Canal Anniversary Committee, being an opportunity to showcase the Town.
TA Guerino noted having an in depth discussion of Selectmen’s/TA Budget for next week.
TA Guerino noted Dawn DiLoretto (Clerk’s Office) is leaving the Town of Bourne and will be missed.
Other Selectmen Business
Selectman Conron requested seeing documentation for requests in budget. She also commented on motion made on December 11, 2007 re: Courtyard public hearing and would like to see on next week’s agenda.
Selectmen's Report
Selectman Ford and Selectman Conron both attended the UCT budget review
meeting, as well as the Finance Committee meeting.
Selectman Zuern attended SMB meeting.
Chm. Mealy recognized the Bourne Sailing Program having received the
Most Outstanding New Program Award.
Jim Mulvey noted hearing comments from the public re: Bridge Park and
see what the public wants.
