Pursuant to Chapter 111, section 31, Mass. General Laws, the Bourne Board of Health voted at its regular meeting held on January 9, 1991, to amend the Dog and Cat Kennels, approved May 31, 1978, to be as follows:
DOG AND CAT KENNELS
Dog and cat kennels mean any building, lot, structure, enclosure, or premises, or portion thereof where more than three (3) dogs or cats three months old or older - are kept or maintained for any purpose.
1. LOCATION
A. Dog and cat kennels shall be located not closer than 100 feet from: any building used for human habitation, any church, school, public building, park, playground, hospital, nursing home, or rest home except upon written permission of the Board of Health.
B. Dog and cat kennels shall be located not less than 50 feet from adjoining property lot lines or the line of any street, court, or passageway, unless written permission from the Board of Health is obtained after a hearing with the applicant, abutters, and other interested parties.
C. Not less than 250 feet from the high water mark of any source of drinking water supply or any tributary thereof, or less than 250 feet from the high water mark of any open waters flowing directly or ultimately into any source of water supply.
2. CONSTRUCTION
Single or multiple housing units for dogs and cats should be of durable construction to protect structures from termites, dampness, deterioration, and rodents.
3. FLOORS
The floor surface in all kennels shall be smooth and non-absorbent and so constructed as to be easily cleaned. Floors and outside runs of each cubicle shall be cleaned at least once daily.
4. FEED ROOMS
The owner shall provide for tightly covered and vermin-proof storage of dried feed and shall provide refrigeration facilities for the keeping of so called fresh animal food, edible meat, fish and poultry.
5. EQUIPMENT
All equipment used at feeding stations shall be of easily cleanable material.
6. WATER SUPPLY
An adequate quantity of water shall be provided for feeding of animals and cleaning purposes.
7. ANIMAL WASTES
Animal wastes shall be removed from the premises, regularly, at a minimum of once per week, and until removal shall be stored in a container or area to prevent odor, flies, and run-off. Such material may be composted if said pile is kept odor and insect free.
8. COMPLAINTS
Any complaints received regarding the maintenance or removal of the animal waste, or any other public health concern will cause a hearing before the Board of Health. Any notice of violation will be forwarded to the Appeals Board.
