Article 4.1 Department of Inspections

Section 4.1.1

Officers.  There shall be a Department of Inspections under the supervision of the Inspector of Buildings. This
Department shall include the Inspector of Buildings, the Inspector of Wires, the Gas Inspector, the Plumbing I
nspector
and  Public Weighers.

Section 4.1.2 

Appointments The Inspector of Buildings, Inspector of Wires and Public Weighers shall be appointed annually by the
Town Administrator and shall hold office for the term of one (1) year or until such time as their successors are appointed. 
The compensation of such officers shall be established by the Town Administrator. The Plumbing Inspector and Gas
Inspector shall be appointed by the Inspector of Buildings in accordance with applicable state law.

Section 4.1.3

Duties.  The duties of such officers shall be as from time established by state law and such additional duties as shall
be set forth herein.

Article 4.2 Commonwealth of Massachusetts State Building Code

Section 4.2.1

Purpose.  The purpose of the by law is to make provisions complimentary to those of the Commonwealth of
Massachusetts' State Building Code ("Basic Code") in order to ensure its appropriate application and effective
administration in the Town of Bourne.

Section 4.2.2

Record Keeping.  The Inspector of Buildings shall keep consolidated records of all inspections made pursuant to the
Basic Code or any other by
law or regulations concerning the erection, alteration and demolition of the buildings within the Town.

Section 4.2.3

Permit Fees.  A schedule of fees for permits as authorized under Section 118.0 of the Basic Code shall be established and
revised from time to time by the Board of Selectmen.  

Section 4.2.4

Fire Districts.  The entire Town shall be designated as "Outside Fire Limits", as referred to in Section 301.3 of the Basic Code.

Article 4.3 Inspector of Wires

Section 4.3.1

Record Keeping.  The Inspector of Wires shall submit to the Selectmen such statements and information in regard
to the matters within his jurisdiction as they may from time to time require. He shall keep a full and complete record 
of his inspection in duplicate, one copy of which shall be filed with
the Town Clerk in January of every year, and one
copy retained by him as the permanent record of his office.  

Section 4.3.2

Installation of Electricity Carrying Devices.  No person shall install wires, conduits, apparatus, fixtures or other
appliances for carrying electricity for light, heat or power within or connected to any building, without first notifying
the Inspector of Wires, in writing, of the proposed installation. Whoever violates this by
law shall be punished by a
fine of not more than twenty dollars.  

Section 4.3.3

Electric Service Entrance Equipment.  All electric service entrance equipment, installed in or on any structure for
the purpose of providing a point of attachment to a source of supply of electric energy, its metering, its disconnection
means and its protective devices, shall be installed in or on any structure only by a properly licensed electrician. 

Article 4.4 Gas Inspector

Section 4.4.1

Installation of Gas Devices.  No person shall install, repair or modify gas pipes, apparatus, fixtures or other
appliances without first notifying the Gas Inspector in accordance with applicable laws and regulations.  

Article 4.5 Numbering of Buildings

Section 4.5.1

Placement.  Every building used for a dwelling house or a place of business in the Town of Bourne shall bear in
a conspicuous place on the portion of the building facing the street, or if not readable from the street, on a suitable
post or object at least three (3) feet above the ground, the number assigned to it by the Town Engineering Office in
at least four (4) inch, Arabic style numbers contrasting with the background. If the number appears on a post or
object, said object must be located at the entrance to the driveway or accessway serving the building so as to be
visible from the street of which the number is assigned.  Each entrance to a multiple unit dwelling must bear a
suitable number or letter as specified in this bylaw.  Such numbers shall be affixed by the owner prior to occupancy
of new structures, or prior to any inspections required by any permits, or within three months of notification of
assignment in the case of existing buildings.  Any pre-existing conflicting numbers shall be removed within the
same time limit.

Section 4.5.2

New Buildings.  Prior to the application for a building permit for a dwelling house or place of business, the
applicant shall obtain the correct street number from the Town Engineering Office. This street number shall
appear on such application for a building permit. 

Section 4.5.3

Violations.  This shall be enforced by the Inspector of Buildings or any member of the Police Department.
Any person who fails to affix an  assigned  street number or who unlawfully removes, defaces or changes
a number affixed to a building under this by
law, or affixes thereto a number other than that assigned to
it by the Town Engineering Office, shall be punished by a fine of not more than twenty dollars.

Article 4.6 Sealer of Weights and Measures

Section 4.6.1

Inspection Fees. The Sealer of Weights and Measures shall receive the following fees for sealing the
following weighing and measuring devices:

a.      Each scale with a weighing capacity of more than ten thousand pounds, $100.00. *

b.      Each scale with a weighing capacity of five thousand to ten thousand pounds, $75.00. *

c.       Each scale with a weighing capacity of one thousand to five thousand pounds, $50.00. *

d.      Each scale with a weighting capacity of one hundred to one thousand pounds, $25.00.

e.      Each scale or balance with a weighing capacity of more than ten and less than one hundred pounds, $20.00.

f.        Each scale or balance with a weighing capacity of ten pounds or less, $15.00.

g.      Liquid capacity measure, except vehicle tanks, capacity one gallon or less $5.00,
      more than one gallon $10.00 and measures on pumps $4.00. *

h.      Each liquid measuring meter, except water meters, the diameter of the inlet pipe of which is one half inch or
less, $10.00 - more than one half inch but not more than one inch, $2
5.00; for each such type of liquid measuring
meter, the diameter of the inlet pipe of which is more than one inch, the following shall apply, vehicle tank pump
$
50.00, vehicle tank gravity $35.00, bulk storage $50.00, bulk storage user furnishes certified prover $30.00.

i.        each taximeter or measuring device used upon vehicles to determine the cost of transportation, $25.00. *

j.        Each machine or other mechanical device used for determining linear or area measurement, $10.00.  *
     Tape measures and yardsticks used for linear measure, $10.00.

k.      Milk bottles or jars, $10.00 per gross.

l.        Vehicle tanks used in the sale of commodities by liquid measure shall be charged for each hundred gallons or fraction
      thereof, $6.00. An additional fee of $5.00 per sealed indicator shall be received.

m.     Individual weights $1.00, weight sets $10.00.

n.      The Town of Bourne shall also receive $10.00 for any adjustment or repair, per device, made by Sealer of
      Weights and Measures.

o.      Can or bottle redeemers, $10.00.

p.      Each automated electronic retail checkout system  with fewer than four cash registers or computer terminals, $50.00.

q.      Each automated electronic retail checkout system with no less than four and no more than 11 cash registers or
      computer terminals, $100.00.

r.       Each automated electronic retail checkout system with greater than 11 cash registers or computer terminals, $150.00.
