Summary of Amended Regulation
On 11/15/23, the Bourne Board of Health voted to amend its existing Tobacco Regulations due to changes in state law and the MA Dept. of Public Health’s Minimum Standards for Retail Sale of Tobacco and Electronic Nicotine Delivery Systems following public hearings held 9/27/23 & 10/11/23.
Wording was changed regarding required signage and advertising. Definitions in Section C were updated. Smoking bars will now be prohibited. Single cigars shall not be sold for less than $2.50, a package of 2 or more cigars shall not be sold for less than $5.00. The maximum number of tobacco sales permits allowed to be issued at any time was capped at 32 permits. A unified fining structure for all violation types was adopted; the 1st violation will result in a $1000.00 fine and if the violation included the sale to a person under 21 years of age the sales permit will be suspended for one business day, a 2nd violation within 36 months will result in a $2000.00 fine and a suspension of the sales permit for 14 consecutive business days, and in the case of 3 or more violations within 36 months a fine of $5000.00 shall be issued and the suspension of the tobacco sales permit for 30 consecutive business days. In the case of 4 violations the Board shall hold a hearing regarding potential permanent revocation of a sales permit.
These changes shall be effective 11/24/23
