MS4 Stormwater Permit Overview

The 2003 Small MS4 General Permit expired May 1, 2008 but has been administratively continued.

Operators covered by the 2003 Small MS4 General Permit will remain covered until EPA authorizes their MS4 discharges under a new permit or otherwise revokes permit authorization.

The conditions and reporting requirements of the 2003 Small MS4 General Permit remains fully effective and enforceable until the effective date of a new permit.

Until authorized under a new permit, Operators authorized under the 2003 Small MS4 General Permit are required to submit annual reports by May 1 each year pursuant to Parts II.F, III.F, IV.F or V.F of the 2003 Permit. Annual reports for the period April 1, 2013 –March 31, 2014 are due by May 1, 2014.

2016 Final Permit Documents

The 2016 Massachusetts Small MS4 General Permit was signed April 4, 2016 and will become effective July 1, 2017 (REVISED: POSTPONEMENT OF PERMIT EFFECTIVE DATE
from July 1, 2017 to July 1, 2018). The final permit reflects modifications to the 2014 draft small MS4 general permit released for comment on September 30, 2014 and replaces the 2003 small MS4 general permit for MS4 operators within the Commonwealth of Massachusetts.
