Fire Pits, Chimineas and Outdoor Fireplaces

The Bourne Fire Department allows the use of fire pits, chimineas and outdoor fireplaces without a permit, however, the following conditions must be met:

  • The fire must be used for cooking purposes and reasonable in size.
  • The fire must be constantly attended by an individual that is at least eighteen (18) years old.
  • The fire pit, chiminea or outdoor fireplace must be located on a noncombustible surface at grade level and must not be located under any type of overhang, roof or canopy.

A water source capable of extinguishing the fire should be readily available.   The fire should also be kept away from combustible materials.  The Bourne Fire Department has the right to order that any fire to be extinguished where circumstances make such conditions hazardous.

Massachusetts General Laws do not specifically regulate the use of fire pits, chimineas or outdoor fireplaces however, unless they are being used for cooking, their use is subject to Massachusetts DEP open burning regulations.  Open burning is only allowed, with a permit, from January 15th through May 1st each year.
